These Terms of Use govern all websites owned or operated by Arizona Vacation Getaway LLC, also known as AZVacationHomeRentals.com ("AZVG"), including without limitation any current or future sites it owns or manages (each a "Site" and collectively, the "Sites"). AZVG is located at PO Box 21945, Mesa, AZ 85215.
By using any Site, you agree to these Terms of Use. If you do not agree, discontinue use immediately. AZVG may modify these Terms of Use at any time without prior notice; changes become effective when posted. Your continued use after changes are posted constitutes acceptance.
Description of Service
The Sites allow users to view and inquire about vacation rental properties, for property owners to submit properties for consideration, to view destination information, and to access related services and content (collectively, "Content"). Any new features or services added are subject to these Terms of Use.
Privacy Policy
AZVG’s Privacy Policy describes the information collected through the Sites and how it is used. By agreeing to these Terms of Use, you consent to the collection and use of your information as described in the Privacy Policy.
Disclaimer of Warranties and Limitation of Liability
To the fullest extent permitted by law, AZVG, its affiliates, and their officers and directors (collectively, the "AZVG Parties") disclaim all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement with respect to the Sites, your use of the Sites, and any properties, content, or information you may view.
Your use of the Sites is at your sole risk. The Sites and all Content, products, and services are provided on an "as is" and "as available" basis. The AZVG Parties are not responsible for accuracy, timeliness, delivery failures, or the deletion or failure to store settings or communications.
Under no circumstances will the AZVG Parties be liable to you or anyone claiming through you for any loss or damages of any kind, whether direct or indirect, including without limitation loss of data, goodwill, revenue or profits, or loss or misuse of payment data, arising out of or related to your access to, use of, inability to use, or reliance on any Site or Content. This limitation applies whether based on contract, negligence, tort, strict liability, or any other theory, even if an authorized representative has been advised of the possibility of such damages. If any portion of this limitation is found invalid or unenforceable, the AZVG Parties’ aggregate liability will not exceed one hundred dollars (USD $100). Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.
Indemnification
You agree to indemnify and hold the AZVG Parties harmless from any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising from your use of any Site, your violation of these Terms of Use, or infringement of any third party rights.
Modifications and Interruption to the Sites
AZVG may modify or discontinue any portion of the Sites at any time without notice. The AZVG Parties are not liable for any modification, suspension, or discontinuance. AZVG does not guarantee uninterrupted, error-free, or secure access, and your use may be affected by factors outside AZVG’s control.
Third-Party Sites, Content, and Functionality
The Sites may link to third-party websites and may include functionality or content provided by third parties. AZVG is not responsible for the availability or content of third-party sites or services. Your use of third-party sites is subject to their terms and privacy policies. The AZVG Parties do not guarantee and are not liable for third-party functionality.
Your Obligations
By using the Sites, you represent that you are of legal age to enter a binding contract and are not barred from accessing the Sites under applicable laws.
Providing Information on the Sites
Certain features may require you to provide personal information (e.g., name, email, phone) or travel/property details. You agree to provide accurate, current, and complete information and to update it as needed. AZVG may suspend or terminate your use if it believes provided information is inaccurate, incomplete, or untrue.
Disclaimer Regarding Accuracy of Content
Some Content is provided by third parties. The AZVG Parties make no representations or warranties regarding third-party Content, listings, or services, and any reliance is at your own risk. You agree to hold the AZVG Parties harmless for claims relating to third-party properties or services.
Copyright and Trademark Information
All Content on the Sites, including design, text, graphics, and their selection and arrangement, is protected by applicable intellectual property laws and is owned by AZVG, its affiliates, or third-party licensors. Except for personal, non-commercial use, any reproduction, modification, distribution, data extraction, or commercial exploitation without prior written permission of an authorized AZVG officer is prohibited.
You may not use robots, spiders, or similar tools to monitor or copy pages or Content without written permission, except for search engines. You may download or print a single copy of Content for personal, non-commercial use if you do not remove proprietary notices. Trademarks displayed on the Sites are the property of their respective owners and do not imply endorsement or affiliation.
Links to the Sites; Prohibited Framing
You may create hyperlinks to Site content if links accurately describe the content. You may not frame the Sites or copy portions to a server except for incidental caching by internet service providers. When accessing any page via a link, that page must appear in full as originally displayed. AZVG may revoke link permissions at any time.
Governing Law and Venue
The Sites are operated in the State of Arizona. Arizona law governs these Terms of Use, without regard to conflict of law rules. AZVG makes no representation that the Sites are appropriate or available outside the United States. The state and federal courts located in Arizona are the exclusive venue for disputes arising from the Sites or these Terms of Use.
Compliance with Laws
You are responsible for complying with all applicable local, state, federal, and international laws in connection with your use of the Sites.
Other Terms
If any provision of these Terms of Use is unlawful, void, or unenforceable, the remaining provisions remain in effect to the maximum extent possible. AZVG may assign these Terms of Use in connection with a merger, acquisition, or similar event. These Terms of Use constitute the entire agreement regarding your use of the Sites and supersede prior agreements, except that they do not supersede any separate written agreements you may have with AZVG (e.g., to provide Content or to rent a property). AZVG’s failure to exercise any right is not a waiver. Any claim arising out of or related to the Sites or these Terms of Use must be filed within one (1) year after it arose, or it is permanently barred.
